Terms of Service

By creating an account, accessing, or using any part of the SenderWiz platform ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree with any part of these Terms, you must not use the Platform. We recommend reviewing these Terms periodically, as continued use of the Platform after any changes constitutes your acceptance of the updated Terms.

To access SenderWiz, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account
• You must provide a valid email address and accurate billing information
• You are responsible for keeping your password secure and not sharing access with unauthorized parties
• You must notify us immediately if you suspect unauthorized access to your account
• One person or legal entity may not maintain more than one free trial account
• You may not use another person's account or allow others to use yours without authorization

SenderWiz is designed for legitimate email marketing, transactional email, and business communication. You agree to use the Platform responsibly and in compliance with all applicable laws. You must not use SenderWiz to:

• Send unsolicited bulk emails (spam) or messages to recipients who have not given explicit, verifiable consent
• Send emails to purchased, rented, scraped, harvested, or appended email lists
• Distribute malware, viruses, phishing content, ransomware, or any malicious software
• Send deceptive, fraudulent, or misleading content including fake invoices, impersonation, or social engineering attacks
• Violate any applicable local, state, national, or international law or regulation including CAN-SPAM, CASL, GDPR, and PECR
• Infringe on the intellectual property rights, trademarks, or copyrights of others
• Harass, threaten, defame, abuse, stalk, or intimidate any individual or entity
• Send content related to illegal gambling, unlicensed pharmaceuticals, counterfeit goods, or other prohibited industries
• Attempt to bypass or circumvent sending limits, rate limits, or any platform restrictions
• Interfere with the operation, security, or integrity of the Platform or its infrastructure
• Use the Platform for cryptocurrency, NFT, or high-risk financial solicitations without prior written approval

We reserve the right to suspend or terminate accounts that violate these guidelines without prior notice. See our Anti-Spam Policy for detailed enforcement standards.

We strive to maintain 99.9% platform uptime but do not guarantee uninterrupted or error-free access at all times. We reserve the right to:

• Perform scheduled and emergency maintenance with reasonable notice when possible
• Modify, update, or discontinue features or functionality of the Platform
• Impose usage limits or restrictions to ensure fair use across all customers
• Temporarily suspend service during infrastructure upgrades or security incidents

We will make commercially reasonable efforts to notify you of material changes to the service. Scheduled maintenance windows are communicated via email and our status page.

Paid subscription plans are billed in advance on a monthly or annual basis depending on your chosen plan. By subscribing to a paid plan, you authorize us to charge your designated payment method for all applicable fees.

• All prices are listed in USD unless otherwise specified — we also offer geo-specific pricing in select currencies
• Subscription fees are non-refundable except as outlined in our Refund & Cancellation Policy
• We reserve the right to change pricing with at least 30 days' advance notice via email
• Price changes take effect at the start of your next billing cycle — existing billing periods are honored at the original rate
• Failed payment attempts may result in service interruption after a grace period of 3 days
• Add-on purchases (dedicated IPs, domain warmup, etc.) are billed separately and may have different refund terms
• Annual plans receive a discounted rate compared to monthly billing — early cancellation of annual plans may forfeit the discount
• All applicable taxes (GST, VAT, sales tax) are charged in addition to the listed price based on your billing location

You retain full ownership of all content, data, subscriber lists, email templates, and materials you upload to or create on the Platform. We do not claim any intellectual property rights over your content.

• You grant SenderWiz a limited, non-exclusive, worldwide license to process, store, and transmit your data solely for the purpose of providing and improving our services
• You are responsible for ensuring you have the necessary rights and permissions to use all content you upload, including images, text, and subscriber data
• SenderWiz owns all rights to the Platform, its software, design, branding, trademarks, documentation, and underlying technology
• Feedback, suggestions, or feature requests you provide may be used by us to improve the Platform without obligation or compensation
• Upon account deletion, your data will be permanently removed within 30 days, except where retention is required by law

Either party may terminate this agreement at any time. You may cancel your account through your dashboard settings or by contacting our support team.

• We may suspend your account immediately if we detect a violation of these Terms, our Anti-Spam Policy, or any applicable law
• We may terminate accounts that have been inactive for more than 12 consecutive months
• Upon cancellation, your access continues until the end of your current paid billing period
• Accounts terminated for policy violations are not eligible for refunds
• You may request an export of your data before account closure — we will provide your data in a standard machine-readable format within 7 business days
• We reserve the right to retain certain data as required by law, even after account termination

To the maximum extent permitted by applicable law, SenderWiz and its parent company Decet Technology, along with their officers, directors, employees, agents, and affiliates (collectively, "SenderWiz Parties"), shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages of any kind
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from service interruptions, security breaches, or unauthorized access to your account
• Damages resulting from third-party actions, content, or services integrated with the Platform
• Damages exceeding the total amount you paid to SenderWiz in the 12 months preceding the claim

The Platform is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Platform's fitness for a particular purpose, merchantability, or non-infringement.

You agree to indemnify, defend, and hold harmless SenderWiz, Decet Technology, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use or misuse of the Platform
• Your violation of these Terms or any applicable law or regulation
• Your email campaigns, content, or subscriber lists
• Any claim by a third party that your use of the Platform infringed their rights
• Your failure to comply with applicable email marketing laws (CAN-SPAM, GDPR, CASL, etc.)

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

• Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India
• Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days
• Nothing in these Terms limits your rights under applicable consumer protection laws in your jurisdiction

The Platform integrates with third-party services to provide core functionality. By using the Platform, you acknowledge and agree to the use of the following:

• Google reCAPTCHA: Used on our contact forms to prevent spam and abuse. reCAPTCHA collects device and browser information and sets a cookie (_GRECAPTCHA) for risk analysis. As of April 2, 2026, Google acts as a data processor for reCAPTCHA data under the Cloud Data Processing Addendum
• Payment Processing: Stripe processes all payments — we never store full credit card numbers on our servers

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email and/or by posting a prominent notice on the Platform at least 14 days before the changes take effect.

Continued use of the Platform after the effective date of updated Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Platform and close your account.
